HOA architectural committees in Travis County must follow TX Property Code 209.00505, which allows owners to appeal denials to the board. State law preempts HOA bans on solar panels, drought-resistant landscaping, rain barrels, and certain flags.
TX Property Code 202.010 prohibits HOAs from banning solar energy devices (some aesthetic conditions allowed). 202.007 protects drought-resistant landscaping, composting, rain barrels, and efficient irrigation. 202.011 protects display of US, Texas, and military flags on poles up to 20 feet. 209.00505 requires ARC decisions to be in writing with reasons, and owners have 30 days to appeal to the board. HOA cannot enforce against religious displays on entry doorframes under 202.018.
