Fort Wayne HOAs may levy regular and special assessments per governing documents. IC 32-25 and 32-25.5 require written notice, reasonable collection, and allow liens on delinquent units. No city-level rules apply.
Regular assessments fund ongoing operations and reserves. Special assessments for capital projects typically require a higher membership vote threshold set by the declaration or bylaws. Indiana Code permits HOAs and condo associations to record a lien against a unit for unpaid assessments and, after proper notice, foreclose on that lien. IC 32-28-14 governs HOA lien procedures in planned communities. Late fees and interest are limited to amounts set in the governing documents or a reasonable rate. Fort Wayne does not cap assessment increases; that is a matter of state law and the governing documents. Members have the right to review the association budget and reserve study.
No city fines. Associations seeking to collect file civil actions in Allen County courts.
