Under the Alabama Uniform Condominium Act ยง35-8A-316, condo associations have a statutory lien on units for unpaid assessments with priority over most liens except first mortgages and taxes. Non-condo HOAs rely on their recorded CC&Rs for lien authority. Alabama permits judicial and nonjudicial foreclosure of HOA liens depending on declaration terms.
