Port St. Lucie, FL HOA Rules: Board Governance (2026)

Florida Chapter 720 mandates specific governance standards for Port St. Lucie HOAs. Board meetings must be noticed at least 48 hours in advance by posting on the community property (or as governing documents specify). Members have the right to attend, speak on agenda items (minimum 3 minutes each), and record meetings. Board elections occur annually unless covenants provide otherwise, with secret-ballot voting required if contested. Official records (financial statements, meeting minutes, contracts, covenant documents, member roster, budget) must be made available for inspection within 10 business days of a written request per FL 720.303(5); willful denial of records incurs statutory damages of $50/day up to 10 days. Board members have fiduciary duties and may be recalled by majority of voting interests. Annual budgets must be distributed to members at least 14 days before adoption. Reserves for capital replacement are not required under FL 720 (unlike condominiums under FL 718), but many covenants require them. Board members must complete a certification course or sign an affidavit under FL 720.3033.
