Port St. Lucie Code section 94.06(c) bars loudspeakers and sound amplifiers in or adjacent to residential areas between 10:00 p.m. and 7:00 a.m. on weekdays and 10:00 p.m. and 10:00 a.m. on weekends and holidays when plainly audible across the property line, and section 94.06(b) prohibits amplified sound that is unreasonably loud or audible on public rights-of-way.
Amplified music is regulated under the 'Specific prohibitions' of section 94.06. Subsection (c) prohibits using any loudspeaker, loudspeaker system, sound amplifier or similar device between 10:00 p.m. and 7:00 a.m. on weekdays, and 10:00 p.m. and 10:00 a.m. on weekends and holidays, within or adjacent to residential areas where the sound is plainly audible across the source's real property line, unless a city permit has been obtained for a public performance, gathering, parade or park activity. Subsection (b) separately prohibits operating a radio, tape player or other electronic sound-making device so that it is plainly audible to others on the public rights-of-way, is unreasonably loud or a nuisance, causes perceptible physical vibration inside a residence, or exceeds the Table I limits of section 94.04. Persons jointly liable include any performer or disc jockey, any person controlling volume, and the business of record (section 94.03). Relief from these limits requires a $25 special permit from the chief of police under section 94.07.
Penalties are imposed under Chapter 37 of the City Code per section 94.08(d); the city may also revoke a business tax receipt under section 111.26 or seek injunctive relief (section 94.08(e)). Each violation is a nuisance under section 94.09.
