Olathe regulates inflatable displays primarily as commercial sign devices under UDO Sec. 18.50.190 (Signs). Inflatables up to thirty feet in height are permitted, except on roofs, for two thirty-day periods per calendar year, with no consecutive month-to-month carryover. Residential holiday inflatable lawn decorations (giant Santas, snowmen) are generally treated as temporary residential decorations rather than commercial signs.
Under UDO Sec. 18.50.190, inflatable devices up to thirty (30) feet in height are permitted on commercial and similar non-residential properties, except on roofs, for two (2) thirty (30) day periods per calendar year, and in no case will a thirty (30) day period be carried over from month-to-month consecutively. The Sec. 18.50.190 framework primarily targets commercial promotional inflatables (giant air dancers, advertising blimps, inflatable mascots). Residential holiday lawn inflatables β large air-blown Santas, snowmen, pumpkins, and similar seasonal decorations on single-family lots β are typically treated as temporary residential decorations and are not subject to the commercial inflatable limits, though they remain subject to general nuisance provisions under O.M.C. Title 8 and any HOA CC&R restrictions. Inflatables may not encroach into the public right-of-way, block sight-distance triangles defined under UDO Sec. 18.30.220, or be placed on roofs. Lighting on inflatables must comply with UDO Sec. 18.30.135 lighting standards and may not produce glare onto adjoining residential property. Commercial sign permits are administered by the Planning Division. Kansas has no statewide preemption β KSA 12-741 et seq. delegates sign and inflatable regulation to cities.
Operating an inflatable display in violation of UDO Sec. 18.50.190 (e.g., on a roof, exceeding 30 ft height, beyond two 30-day periods per year, or in consecutive months) may trigger a Code Enforcement notice with order to remove and possible municipal court fines. Roof installations and right-of-way encroachments draw more aggressive enforcement.
