Modesto, CA Holiday Decorations: Lawn Ornament Rules (2026)

MMC Title 10 (Zoning) does not regulate ornamentation of private residential yards in Modesto. Lawn ornaments are not signs under MMC Title 10 unless they bear commercial advertising, and they are not structures triggering setback or building permit rules unless they exceed accessory-structure thresholds (typically anything anchored to a permanent foundation or exceeding the underlying zone's accessory-structure height limit). Modesto does not enforce HOA-style aesthetic rules - those are matters for private homeowner-association covenants and CC&Rs. The city's authority is limited to: (1) right-of-way encroachment under MMC Title 7 - ornaments may not be placed in the parkway strip, sidewalk, or street; (2) the Property Maintenance Code at MMC 9-9.509, which requires that exterior premises be kept free of accumulated rubbish, debris, and dilapidated items; and (3) general public-nuisance authority under MMC Title 4 and Cal.
