Modesto has no blanket overnight parking ban. The default rule is the 72-hour storage limit (sec. 3-2.1002). Residential Parking Permit Zones under Article 19 of Title 3 restrict on-street parking to permit holders in designated neighborhoods, and living overnight in a vehicle on private property is barred by section 10-3.211 after 72 consecutive hours.
Modesto does not impose a citywide ban on overnight on-street parking. The general control is Modesto Municipal Code § 3-2.1002 (72-hour storage limit, $108 fine). In neighborhoods where the City Council has by resolution established a Residential Parking Permit Zone under Modesto MC Title 3, Article 19 (sections 3-2.1901 through 3-2.1910), on-street parking during posted hours is reserved for vehicles displaying a valid residential parking permit. Section 3-2.1904(a) (no residential parking permit) carries a $61.00 fine, and subsections (c), (d), and (e) (misuse, alteration, or fraudulent transfer of a permit) carry a $500.00 fine per the City's Parking Violation Fine Schedule. Posted no-stopping or no-parking signs in specific time bands are enforced under sections 3-2.1007 ($61) and 3-2.1203 ($56). On private property, section 10-3.211 makes it 'unlawful for any person to occupy or permit the occupancy of any mobile living quarters on property subject to their control, within the City of Modesto, for more than seventy-two (72) consecutive hours,' with a narrow emergency exception (up to 120 days with Director approval where fire or natural disaster has rendered a home uninhabitable). 'Occupy' is defined as exhibiting intent to live in mobile living quarters - sleeping, eating, cleaning, using utilities, or keeping personal goods inside.
On-street: $108 for 72-hour storage (sec. 3-2.1002); $61 for no residential permit (sec. 3-2.1904(a)); up to $500 for permit misuse (sec. 3-2.1904(c)-(e)); $56-$61 for violating posted no-parking signs (sec. 3-2.1007, 3-2.1203). On private property: zoning enforcement under sec. 10-3.211 plus nuisance abatement under Title 9 if a vehicle is occupied as a dwelling beyond 72 hours.
