Under Modesto Municipal Code Title 10 (Zoning), § 10-3.202 (Animals and Fowl), a residential dwelling unit may keep: (a) up to twelve (12) domestic fowl - 'hens only' - rabbits, hares, or similar small household pets per dwelling unit; (b) up to two (2) pygmy goats or other small domesticated animals compatible with residential uses, three months or older, per dwelling unit; (c) up to two (2) miniature potbellied pigs, excluding boars, three months or older, per dwelling unit; and (d) up to thirty (30) racing homer pigeons maintained in pens or lofts on a lot containing at least one dwelling unit. All such animals (other than household pets kept in habitable buildings) must be contained in pens, coops, or cages. There must be a minimum of 40 feet between the window or door of any building used for human habitation and any pens, coops, or cages housing animals or fowl. There must also be a minimum separation equal to the required side yard between any property line and any animal housing. Roosters are not permitted in residential zones. Larger livestock (cattle, horses, swine other than mini potbellied pigs) and commercial poultry operations are confined to agricultural zones. No coop permit is required for keeping up to 12 hens at home so long as the setback and containment rules are met.
Keeping roosters, exceeding the 12-hen limit, or violating the 40-foot setback is a zoning violation enforceable by Modesto Code Enforcement (209-577-5250). Violations are prosecuted by the City Attorney as infractions or misdemeanors, subject to fines and abatement orders requiring removal or relocation of the animals or housing. Noise complaints about poultry can also trigger nuisance enforcement under MMC Title 4.
