Sales must be direct to the customer at places like farmers markets, roadside stands, and home. Every product must be labeled with the producer's name and address, ingredients, allergens, net weight, and the statement that it was made in a home kitchen not inspected by MDARD. The gross-sales cap, long set at $25,000, was raised to $50,000 through October 1, 2026.
Selling potentially hazardous foods, skipping the required labeling, or exceeding the sales cap pulls the operation under full food-establishment licensing and MDARD enforcement.
