Apple Valley requires a Home Occupation Permit before engaging in a home occupation, under Development Code Chapter 9.19. The Planning Division reviews applications without a public hearing. The application processing fee is $114, and a current business license is required before the home occupation begins.
Under the Town Development Code, no person may engage in a home occupation without first obtaining approval of a permit from the Planning Division, which approves, conditionally approves, or denies applications without a public hearing. The Town's application form sets the processing fee at $114. Operating standards in Section 9.19.050 require complete conformity with Fire, Building, Plumbing, Electrical, and Health Codes and all applicable State and Town laws. A home occupation must be carried out primarily by a full-time resident of the dwelling, with one additional employee permitted if the required findings can be made. Operations are restricted to Monday through Saturday, 8 a.m. to 5 p.m. No home occupation may begin until a current business license is obtained, the permit is not transferable, and on rental property the owner's written authorization is required before submittal. Section 9.19.070 prohibits certain uses entirely as home occupations - including medical and dental offices, automotive and vehicle repair, on-site retail (except agricultural products), beauty and barber shops, dancing or exercise studios, animal hospitals, junk yards, massage parlors, mini-storage, welding and machining, and storage of construction-trade equipment. The Town Manager or designee may revoke a permit for noncompliance.
Operating without a Home Occupation Permit or business license, running a prohibited use, exceeding the one-employee limit, or operating outside the Monday-Saturday 8 a.m.-5 p.m. window violates Chapter 9.19. Permits may be revoked, including after two or more valid complaints from different parties within a six-month period.
