Operators must still be licensed by the California Department of Social Services, Community Care Licensing, which sets capacity (small vs. large) and health-and-safety standards.
Because state law makes family daycare a use by right, a Town attempt to require a use permit or impose a business license or fee would be preempted. The enforceable requirements are state licensing through Community Care Licensing; operating an unlicensed daycare exceeding the allowed number of children is a state-law violation.
