In Yellowstone County zoning districts, a home occupation must stay within the home or an accessory building, use no more than 25 percent of one story, employ only immediate family, and create no noise, vibration, glare, fumes, or odors off the premises. A permit application is required.
The county's adopted home occupation standards set several conditions: no one other than an immediate family member (plus domestic help) may be employed; no stock in trade is displayed or sold on the premises; no dwelling alteration that changes its residential character; no more than 25 percent of one story is devoted to the use; and no equipment may create noise, vibration, glare, fumes, odors, or radio/TV interference off-site. Certain uses (vehicle or boat repair, building-component prefabrication, furniture and appliance sales/repair/storage) are prohibited outright. Applicants file a home occupation permit application; approval is site- and owner-specific and does not transfer to a new owner.
Violating the permit conditions is grounds for cancellation or revocation of the home occupation approval, and revocation or non-renewal of any related business license within a city.
