Dallas County has no home occupation permit program for unincorporated areas. Under Texas law, counties do not have the general zoning power granted to cities, so Dallas County cannot require a land-use permit to operate a business from a home in an unincorporated area. Residents instead register their business at the state level through the Texas Secretary of State (for LLCs and corporations) and file any DBA (assumed name) with the Dallas County Clerk under Texas Business & Commerce Code Chapter 71. If the residence lies within a subdivision with deed restrictions or an HOA, private covenants frequently prohibit or limit commercial use and are enforced in civil court, not by the county. Most unincorporated Dallas County territory is inside the extraterritorial jurisdiction (ETJ) of Dallas, Mesquite, Garland, Irving, or other cities, which may impose subdivision platting rules but not full zoning. Home businesses that prepare food for direct sale fall under the Texas Cottage Food Law (Health & Safety Code Chapter 437), which preempts local permitting for qualifying baked goods, jams, and similar items.
