Cottage food operations in unincorporated Dallas County are governed by Texas Health and Safety Code Chapter 437. TX HSC Section 437.0192 explicitly prohibits local governments (including counties) from regulating cottage food production operations or requiring permits, licenses, or fees. Cottage food operators must complete a basic food safety training program accredited under TX HSC Chapter 438(D). Allowed products include baked goods, candy, dried fruits, nuts, jams, and other non-time-temperature-controlled foods. Sales may occur at the operator's home, at farmers markets, at farm stands, through the internet, or by mail order. Annual gross revenue cannot exceed $50,000. All products must be labeled with the operator's name, address, and the statement that the food is made in a home kitchen not inspected by health departments.
