Conroe has no zoning code, so home-based businesses are not restricted by residential zoning. Businesses must not create nuisances under Chapter 26. Deed restrictions in many subdivisions may prohibit commercial activities.
Because the City of Conroe has no zoning ordinance, home-based businesses are not subject to residential zoning restrictions. The city can issue a Letter of No Zoning upon request from the City Planner's office at 936-522-3608. Operations must comply with Chapter 26 nuisance provisions; a home business generating excessive traffic, noise, odors, or other disturbances may be cited. Sales tax, HOT (if applicable), and other state tax obligations apply. Food trucks require separate permits under Sec. 18-131 through 18-236. Deed restrictions in many Conroe subdivisions prohibit or limit commercial activities in residential areas.
Nuisance citations up to $2,000 if the business creates disturbances. Deed restriction violations may be enforced civilly by an HOA.
