Sec. 159.122 lists prohibited home occupations including: medical or dental offices, law offices, churches/houses of worship, dance studios, vehicle and equipment repair (any internal-combustion-engine repair or assembly), restaurants, hair salons with 2+ chairs, massage parlors and massage studios, private schools, landscaping services, in-home therapy/counseling services, and firearms-related operations. Noblesville's zoning authority derives from IC 36-7-4 (Local Planning and Zoning) and the home-rule grant in IC 36-1-3-4. Indiana has no statewide Home-Based Business Protection Act preempting municipal home occupation rules (unlike Florida HB 403 or Arizona HB 2333), so Sec. 159.122 controls.
Operating a home business without an approved permit, exceeding the 600 sq ft / 25 percent footprint cap, or running a prohibited use (auto repair, salon with 2+ chairs, massage studio) is enforced by Noblesville Code Enforcement under UDO Sec. 159.046 and the city's general penalty provisions (Sec. 10.99). Remedies include notice of violation, stop-use orders, daily civil penalties, and injunctive relief in Hamilton County Superior Court. Repeated violations may result in revocation of the Home Occupation Permit.
