Spring Hill is an unincorporated CDP in Hernando County governed by the Hernando County Land Development Regulations (LDR) Appendix A Zoning. Spring Hill, FL is an unincorporated census-designated place in Hernando County and is governed entirely by the Hernando County Code of Ordinances Appendix A (Zoning) and the Land Development Regulations administered by the Hernando County Building Division and Planning Department. The state-preempted standards permit: (1) the business may operate in any area zoned for residential use; (2) employees of the business who reside in the dwelling, plus up to 2 non-resident employees or independent contractors working on-site; (3) parking, vehicles, equipment, deliveries, and customer/client visits are protected as long as they comply with the same standards as comparable residential uses; (4) external appearance must remain consistent with the residential character of the neighborhood; (5) all activities must be secondary to the dwelling's residential use; (6) no noise, vibration, heat, smoke, dust, glare, fumes, odor, or electrical/electronic interference detectable beyond the property line. Spring Hill home businesses are subject to Hernando County Business Tax Receipt (BTR) requirements under Hernando County Code Chapter 18 and Florida Statute Chapter 205 β the BTR is administered by the Hernando County Tax Collector.
Home-based business violations are addressed first under Hernando County Code Enforcement procedures (Hernando County Code Chapter 10) but FS 559.955(4) creates a state-law affirmative defense and authorizes a person aggrieved by an improper local restriction to seek declaratory and injunctive relief plus attorney's fees and costs. The aggrieved homeowner may also recover damages caused by an improper local enforcement action.
