Hernando County may not prohibit customer or client visits to a home-based business under Florida Statute 559.955(3) โ the 2021 Home-Based Business Act expressly preempts local prohibitions on customer traffic. Spring Hill home businesses (in unincorporated Hernando County) may receive clients, deliveries, and vendors as long as parking is in legal spaces (driveway, not the right-of-way, sidewalk, or unimproved surfaces) and the activity is comparable in volume to other residential uses. Up to 2 non-resident employees or contractors may work on-site.
Before HB 403 (2021), Hernando County's Appendix A home-occupation standards (Article III Section 3 Paragraph L) prohibited customer visits to a home occupation. The Hernando County Board of County Commissioners adopted a conforming ordinance on August 24, 2021 (5-0 vote) recognizing that the new Florida Statute 559.955 preempted the customer-traffic prohibition. Under FS 559.955(3)(a) Hernando County may not prohibit, restrict, or regulate visits by employees, customers, or clients to a home-based business in a manner different from comparable residential uses. The statute at (3)(b) permits up to 2 employees or independent contractors who do not reside in the dwelling to work on-site (the homeowner-resident plus family members in the home also count toward operations). Parking, deliveries, traffic, and equipment standards must be consistent with the residential character but the county cannot impose specific customer-traffic caps. FS 559.955(3)(d) requires vehicles and trailers used in the business to be parked in legal parking spaces โ generally the driveway or other improved surface โ and not in the public right-of-way, on or over a sidewalk, or on any unimproved surface (grass or dirt) at the residence. Activities producing detectable off-premises nuisance (excessive horns/engine noise, large delivery trucks with chronic idling, parking spillover that blocks the street, equipment noise) may still be cited under generally applicable Hernando County noise and parking ordinances. Hernando County Code Chapter 10 (Code Enforcement) and Florida Statute 162.09 govern fines. HOA-governed subdivisions in Spring Hill (Timber Pines, Glen Lakes, Wellington, Silverthorn, Sterling Hill) may impose stricter rules under their covenants and Florida Statute Chapter 720.
Customer-traffic disputes that exceed generally applicable nuisance or parking standards are enforced by Hernando County Code Enforcement under Chapter 10 of the County Code with notice of violation and civil fines up to $250/day for a first violation, $500/day for repeats under Florida Statute 162.09. A homeowner cited under a rule that violates FS 559.955 has a state-law affirmative defense and may sue for declaratory and injunctive relief plus attorney's fees and costs under FS 559.955(4). HOA enforcement is a separate civil action under Florida Statute Chapter 720.
