Arkansas prohibits local sanctuary policies under Act 1076 of 2019, codified at Ark. Code § 14-1-103. A city or county that limits cooperation with federal immigration authorities can lose state discretionary funding until the policy is repealed.
Ark. Code § 14-1-103, enacted by Act 1076 of 2019, bars municipalities and counties from adopting sanctuary policies that limit communication or cooperation with federal immigration authorities. Local governments cannot prohibit officials from inquiring about or reporting immigration status or from honoring lawful requests. If the Attorney General opines that a subdivision maintains a sanctuary policy, that subdivision becomes ineligible for state discretionary funds and grants until the policy is repealed. A 2025 act broadened these provisions to reach all political subdivisions.
A subdivision found to maintain a sanctuary policy loses eligibility for state discretionary funds and grants until the Attorney General certifies the policy is repealed.
