Florida Senate Bill 82, effective July 1, 2019, prohibits local governments from regulating vegetable gardens on residential properties. This law was prompted by a high-profile case in Miami Shores. Under this statute, Broward County and its municipalities cannot ban front-yard vegetable gardens. HOAs may still impose reasonable aesthetic requirements (bed materials, maintenance standards) but cannot prohibit food production. Raised beds, container gardens, and in-ground plots are all permitted. Gardens must be maintained and not create nuisance conditions. Broward County's warm climate allows year-round growing. South Florida Water Management District irrigation restrictions may apply to garden watering.
No penalties for maintaining a vegetable garden. Local ordinances banning gardens are preempted by state law. Unmaintained gardens may still be cited under general property maintenance codes.
