Backyard composting is allowed in El Paso County, which sets no county composting ordinance. Texas Property Code Section 202.007 bars a homeowners association from prohibiting solid-waste composting of grass, leaves, or brush.
El Paso County imposes no ordinance regulating residential composting in unincorporated areas, so homeowners may compost yard and food waste on their own property. Texas Property Code Section 202.007 protects the practice by voiding any HOA restriction that stops an owner from composting vegetation, including grass clippings, leaves, or brush, though an HOA may set reasonable conditions such as location or screening. The only county backstop is Health and Safety Code Chapter 343: a compost or debris pile that becomes a public nuisance by harboring rodents, or by being rubbish visible within 300 feet of a public street, can be abated after notice. The County Attorney's environmental unit separately targets illegal dumping and open trash burning, which composting is not.
Ordinary backyard composting is not a violation. A neglected pile that harbors pests or reads as accumulated rubbish near a street can trigger Chapter 343 nuisance abatement after written notice. Burning yard waste may breach environmental rules.
