Lane Code 9.057.574 defines "Noxious Vegetation" to include grass more than ten inches high (unless it is an agricultural crop creating no fire or traffic hazard). LC 9.057.576(C) makes noxious vegetation a nuisance on public or private property within the urban growth boundaries of incorporated cities or in developed/committed areas designated Community or zoned RR-5, RR-2, RR-1 or RA in the Rural Comprehensive Plan. No owner or person in charge may allow it on the property or let it encroach into an abutting right-of-way. Deep rural resource land (EFU/forest) is not covered by the height rule.
Class 1 failure to comply under LC Chapter 5; County may abate and lien the property for abatement costs plus an administrative fee.
