Hidalgo County has no tree-trimming ordinance or permit for private property in unincorporated areas, because Texas counties lack general zoning authority. Property owners may prune their own trees freely; the county only addresses vegetation as a public-health nuisance or where it blocks a drainage easement or county road.
As a Texas county without zoning power, Hidalgo County does not license or restrict routine trimming, pruning, or topping of trees on private land in the unincorporated area. There is no county tree ordinance, heritage-tree list, or maintenance-pruning permit; that regulation is done by cities, not the county. The county's only vegetation interest stems from Texas Health & Safety Code Chapter 343 nuisance abatement. Under its Unincorporated Area Nuisance Abatement Program (Commissioners Court, August 16, 2016), overgrowth that creates an unsanitary condition (343.011 C(3)) or blocks a drainage easement (343.011 C(11)) can be ordered corrected. County crews and the drainage district may also clear vegetation from the right-of-way. Utility line-clearance is handled by the electric provider, not a county permit.
There is no penalty for ordinary tree trimming. Enforcement arises only indirectly: an unsanitary-condition or drainage-easement nuisance under THSC 343.011 can lead to written notice and county abatement with costs charged to the owner.
