Milpitas separates trees into private, protected/heritage, and street-tree categories. Property owners remain responsible for maintaining their own (unapproved) trees and other plantings under MC X-2-5.04 and X-2-6.01. Pruning or removing a street, heritage, or protected tree without the required City permit is unlawful and can trigger code enforcement and replacement requirements. Residents performing unauthorized work on a City street tree may be liable for the value of the tree and required corrective replanting.
