Louisiana is a civil-law state, so tree-trimming between neighbors is governed by the Civil Code, not a parish ordinance. Article 688 gives a landowner the right to demand a neighbor trim encroaching branches or roots, but only when they interfere with enjoyment of the property. Boundary trees are presumed common under Art. 687. For trees or shrubs in the public right-of-way or other public property, UDC Section 18.5 requires a permit from the Development Department before removal, and abutting owners or utilities may prune only under permit, an annual maintenance plan, or a documented emergency performed to ANSI standards.
Pruning a right-of-way tree without a Development Department permit violates UDC Sec. 18.5; the permit may require replacement or a damage bond. Private branch disputes are resolved as civil claims under the Civil Code.
