Aircraft noise is federally preempted by the Federal Aviation Administration (FAA). Delray Beach is near Boca Raton Airport (BCT) and Palm Beach County Park Airport (LNA/Lantana). The city cannot regulate overhead flight noise.
Federal law preempts local and state regulation of aircraft in flight under the Airline Deregulation Act (49 U.S.C. Β§41713) and the Federal Aviation Act (49 U.S.C. Β§40103). The FAA exclusively regulates altitude, flight paths, and operating hours. Delray Beach lies approximately 5 miles south of Boca Raton Airport (BCT)βa general aviation reliever serving private jets and flight schoolsβand approximately 8 miles north of Palm Beach County Park Airport (LNA, Lantana), a high-traffic GA airport. Palm Beach International (PBI) is roughly 18 miles north. Noise complaints must be directed to the FAA Noise Portal (noise.faa.gov) or the individual airport's noise abatement office (BCT operates a voluntary noise-abatement pattern avoiding residential overflight below 1,000 ft AGL). Sea-turtle nesting season (March 1-October 31) brings additional FAA-coordinated low-flight restrictions over Delray's beach per FWC Marine Turtle Protection rules. City Code Enforcement cannot issue citations for aircraft overflight.
No local finesβthe city lacks jurisdiction. Complaints go to: FAA Noise Portal, Boca Raton Airport Authority (561-391-2202), or Palm Beach County Department of Airports (561-471-7420). FAA may pursue certificate action against pilots violating minimum altitude rules (14 CFR Β§91.119).
