As of May 2, 2023, Miami-Dade County Section 21-28 prohibits operation of noise-producing construction equipment and machinery at or near residences, including multi-family residences, between 8 PM and 7 AM in unincorporated areas. Standard permitted construction hours are 7 AM to 8 PM. A Temporary Noise Ordinance Waiver must be obtained before commencing any after-hours work. The waiver application requires an explanation of community need, public purpose, or benefit, plus notification of adjacent and adjoining properties at least 72 hours prior to commencement. Emergency utility work is exempt.
Construction noise violations are enforced under Section 21-28. Fines up to $500 per occurrence. Stop-work orders may be issued for repeated violations. Waiver violations result in waiver revocation.
