Several parts of Sec. 26-23(b) target industrial and mechanical noise: subsection (b)(7) prohibits using any mechanical device operated by compressed air 'unless the noise created thereby is effectively muffled and reduced'; (b)(6) requires stationary engine and motor-vehicle exhaust to pass through an effective muffler; and (b)(5) limits steam-whistle blowing to shift signals or danger warnings. The numeric standards in subsection (d) — 60 dB(A) day and 50 dB(A) night, measured beyond the property boundary — apply to industrial sound. Durham's joint UDO zoning also separates heavy-industrial uses from residential districts to reduce spillover.
Unmuffled or excessive industrial noise is a Class 3 misdemeanor (up to $50, Sec. 1-9); persistent commercial violations may also draw zoning and nuisance-abatement action.
