Durham applies uniform sound limits across all zones under Ch. 26: 60 dBA daytime and 50 dBA nighttime. There is no special higher limit for industrial or commercial zones.
Under Sec. 26-3 and Sec. 26-23, Durham applies uniform sound level limits of 60 dBA (8 AM to 11 PM) and 50 dBA (11 PM to 8 AM) regardless of zoning district. This differs from many cities that set higher limits for industrial zones. When determining whether industrial noise is unreasonably loud and disturbing, Sec. 26-3 directs enforcement to consider the character and zoning of the area, whether the noise relates to normal business operations, and whether it can be controlled without unreasonable effort or expense. Industrial facilities operating near residential zones are held to the same 60/50 dBA standard, which acoustical consultants have noted can be challenging for manufacturing operations. North Carolina municipalities have authority to regulate industrial noise under N.C.G.S. 160A-184.
Industrial noise violations carry the same penalties as general noise violations under Ch. 26. Citations are misdemeanors with fines up to $500. Persistent violators may face injunctive relief through the courts. The city may also pursue nuisance abatement actions against industrial operations generating chronic noise complaints.
