Durham, NC Fence Regulations: Height Limits (2026)

UDO Sec. 1 sets fence and wall height by location relative to the street rather than by district alone. Along "street frontage", generally within 50 feet of a public or private street, a non-electric fence or wall is limited to 4 feet in the city's non-Rural zoning tiers and 8 feet in the Rural Tier. On a corner lot, the side-street frontage allows 6 feet (Other Tiers) or 8 feet (Rural), measured starting at the front building line. Once you're past the street-frontage zone, behind the rear building line, or along a non-electric side yard beyond the required street yard, the "no street frontage" standard applies instead: 8 feet by right for a non-electric fence, or 10 feet for an electric fence.

Electric fencing placed within the street-frontage area specifically requires a Minor Special Use Permit under Sec. 1, though that requirement drops away if the fence instead needs a Certificate of Appropriateness. Posts, columns, and other vertical supports, including lighting or ornamentation on top, are exempt from the height cap as long as fencing material doesn't span support-to-support above the maximum allowed height. Taller fences are also allowed outright around recreational facilities like tennis courts and electrical substations, or where another local, state, or federal rule requires it.

At street intersections, Sec. 1(E) additionally requires that sight distance triangles be maintained under Sec. 1(D) regardless of the fence height otherwise permitted, so corner-lot fencing can be constrained further near the intersection itself.
