Durham UDO Section 9.9 sets general fence standards including setbacks, orientation, and vision-clearance rules. Fences between structures and streets within 50 feet use street-frontage height standards.
Under the Durham Unified Development Ordinance Section 9.9, all fences must comply with general placement and design standards. Fences located between a structure and a street within 50 feet of the street are subject to street-frontage height limits (typically 4 feet in non-Rural tiers). The finished or decorative side must face outward toward adjacent properties and the public right-of-way. Fences must maintain adequate vision clearance at intersections and driveways to preserve pedestrian and vehicular safety. Electric fences are permitted up to 10 feet in Rural areas, but require a minor special use permit when located at street frontage in other tiers. Electric fences must maintain a separation of 4 to 8 inches or more than 3 feet from any perimeter non-electric fence. Fences cannot obstruct fire department access or emergency service routes.
