The City of Durham permits fire pits and outdoor fireplaces on residential property under the North Carolina Fire Prevention Code, NCFC 2018 Chapter 3 Section 307. Recreational fires are defined as fires 3 feet or less in diameter and 2 feet or less in height used for pleasure, cooking, or warmth. Portable outdoor fireplaces constructed of steel, concrete, clay, or other noncombustible material must not be operated within 25 feet of any structure or combustible material and are not considered open burning. Stationary outdoor fire pits built from stone, brick, concrete, or similar materials must be at least 15 feet from structures including decks and 5 feet from property lines per NCFC 307.1. All recreational fires must be constantly attended until fully extinguished. A portable fire extinguisher with a minimum 4-A rating or other on-site fire suppression (water hose, sand, water bucket) must be immediately available. Fire pits may not be used to burn trash or yard waste.
