Industrial noise is judged by zoning: the excessive-noise rule considers the zoning of the source area, and construction in commercial or industrial zones is exempt from the 7pm-7am limit. Vehicular refrigeration units in residential districts, though, are barred 9pm-6am.
The Lake County Noise Control Ordinance factors in the zoning of the area from which noise emanates (Sec. 14-34), so a given sound in an industrial zone is treated differently than in a residential neighborhood. Sec. 14-35 exempts commercial and industrial construction from the residential 7pm-7am limit, and Sec. 14-37 exempts properly permitted commercial/industrial construction and normal agricultural activity. However, Sec. 14-35(2) specifically bars operating vehicular refrigeration units within residential zoning districts between 9:00 p.m. and 6:00 a.m. Interstate motor and rail carrier noise preempted by the federal Noise Control Act of 1972 is also exempt. Industrial operations that spill excessive noise into nearby residential areas can still be cited.
