Commercial and industrial operations in unincorporated Sutter County must keep noise at noise-sensitive receiving properties within 55 dBA day / 45 dBA night hourly Leq. Standard agricultural activities, including frost fans and crop-protection equipment, are fully exempt.
The exterior noise standards in Sutter County Zoning Code Table 1500-21.5-1 apply to any noise source in the county, including commercial and industrial uses, measured at noise-sensitive exterior areas such as residences, schools, hotels, churches, hospitals and nursing homes: 55 dBA hourly Leq daytime (7 a.m.-10 p.m.) and 45 dBA nighttime (10 p.m.-7 a.m.), with 70/65 dBA maximums and a 5 dBA reduction for impulsive or pure-tone noise. Key exemptions in Sec. 1500-21.5-070 reflect the county's agricultural character: noise from agricultural activities in agricultural zones carried out consistent with industry practice is exempt, including wind machines and equipment used for crop protection during adverse weather or pest control (subsection A), as are legally established uses impacting later-arriving sensitive uses (subsection J) and waste collection outside 5:30 a.m.-8:00 p.m. limits near residential zones (subsection I). Operators who cannot immediately comply may seek a temporary noise exception via Zoning Clearance under Sec. 1500-21.5-080.
Exceeding the exterior noise standards at a noise-sensitive receiving property is an infraction and a public nuisance (Sec. 1500-21.5-090). The Director, County Sheriff or assigned officials serve written notice with dBA readings and a corrective-action deadline; continued violations proceed under Zoning Code Article 26 and the noise source may be summarily abated.
