Tarrant County cannot regulate industrial noise from warehouses, rail yards, or oil and gas sites. TCEQ nuisance rules and TX Penal Code 42.01 are the only backstops in unincorporated areas.
Because Texas counties lack both zoning and general noise-ordinance authority, Tarrant County cannot set industrial noise limits for rail yards, intermodal hubs, Alliance-area distribution centers, oil and gas pad sites, or manufacturing facilities in unincorporated areas. Two state-level mechanisms apply. First, Texas Penal Code 42.01 reaches unreasonable noise above 85 dB after warning. Second, the Texas Commission on Environmental Quality enforces nuisance rules under 30 TAC 101.4 that can apply to industrial facilities whose operations cause conditions adverse to human health or welfare. Oil and gas operations are also governed by Texas Railroad Commission Statewide Rules, which include certain setback and flare standards. Inside city limits, Fort Worth, Arlington, and other municipalities enforce their own sound ordinances and gas drilling rules.
