Outdoor music in Summit County is governed by §509.08's ban on unreasonably loud, disturbing sound. Lawfully scheduled festivals, parades, and concerts are exempt, and local subdivisions can issue permits. Residential nighttime noise should stay near 55 dBA.
There is no separate outdoor-music ordinance at the county level; outdoor amplified sound and live performances are handled through §509.08. Frequent, habitual use of loudspeaker systems, musical instruments, or sound-reproduction devices that unreasonably disturb neighbors is prohibited (§509.08(b)(1)A). However, §509.08(e)(4) exempts "Noises from lawfully scheduled sporting events, parades, fireworks, festivals and concerts," and §509.08(e)(8) lets a local political subdivision authorize permits exempting certain noises. So a permitted festival is allowed, but an unpermitted backyard concert booming past 9 p.m. can be cited. Individual municipalities may also require special-event or amplified-sound permits.
Unpermitted disturbing outdoor music is a noise nuisance: warning, then minor misdemeanor, then a 4th-degree misdemeanor with fines up to $250; equipment may be seized.
