Outdoor music in Billings must stay within the district decibel limits and the general noise prohibition. Permitted events in stadiums or parks, and special events, are exempt only if a city waiver has been granted. Unincorporated Yellowstone County sets no outdoor-music ordinance.
Billings City Code Sec. 17-104 exempts 'Permitted events held in stadiums or parks for which a waiver has been granted' (17-104(6)) and 'Special events for which a waiver has been granted' (17-104(8)). Noise from public parks, schools, and recreational facilities is exempt between 7:00 a.m. and 8:00 p.m. (17-104(7)). Without a waiver, outdoor music must comply with Table I limits and the Sec. 17-102 general prohibition against disturbing the peace. Waivers are granted by the city administrator under Sec. 17-106 after weighing time, duration, loudness, and proximity to housing. Unincorporated county land has no equivalent ordinance.
Outdoor music exceeding limits without a waiver is a misdemeanor (Sec. 1-110) and may be abated as a public nuisance.
