Hidalgo County has no outdoor-music or live-entertainment noise ordinance for unincorporated areas. Backyard bands, DJs and festival sound outside city limits are limited only by the state disorderly-conduct statute, and there is no county event-noise permit to obtain.
The county cannot regulate outdoor music venues or events by ordinance, so unincorporated event sites near McAllen, Edinburg and Mission fall under Texas Penal Code Sec. 42.01(a)(5) alone. Sec. 42.01(c)(2) presumes noise unreasonable above 85 decibels only after a magistrate or peace officer first notifies the person that the noise is a public nuisance, giving outdoor performers wide latitude until that notice is given. The Hidalgo County Sheriff's Office handles complaints. Because Texas Health & Safety Code Chapters 341 and 343 nuisance-abatement powers target unsanitary and dangerous physical conditions rather than sound, they do not give the county a music-noise tool. Within incorporated cities, outdoor music is instead governed by the applicable city noise ordinance and special-event permit rules.
Enforcement is limited to Penal Code Sec. 42.01: a Class C misdemeanor, fine up to $500, usually only after officer notice to reduce the sound. No county outdoor-music permit exists, so there is no permit-violation penalty in unincorporated areas.
