Outdoor amplified music in the downtown River District (and citywide) is governed by Sec. 54-197 (Ord. 4012, 2024 - 'Amplified Sound Limitations'): outdoor amplified sound is prohibited 11:00 p.m. - 7:00 a.m. unless a city-issued special-event permit is in effect. Recurring events such as Music Walk (every third Friday, 6-10 p.m.) and Art Walk are operated under city special-event permits.
The downtown River District is the city's primary outdoor-music environment, hosting Music Walk (the third Friday of every month, 6-10 p.m., free public live music across more than a dozen venues), Art Walk on first Fridays, and concerts at the Caloosa Sound Amphitheater on the Caloosahatchee River. Outdoor amplified sound at these venues is regulated by Sec. 54-197 (as rewritten by Ordinance No. 4012 in March 2024): outside of a building, amplified sound is prohibited between 11:00 p.m. and 7:00 a.m. unless a special-event permit has been issued by the city. The 2024 amendment also created Sec. 54-197(c) ('Amplified Noise Disturbances Prohibited') which allows enforcement at any time of day for amplified sound that is 'loud and raucous' or constitutes an 'unreasonable noise disturbance,' on a sworn complaint without an on-scene decibel reading. The 2019 citywide amendment had already extended the prior River-District-only rule to the entire city. Special-event permits are coordinated through the City's Special Event Coordinator using the Special Event Handbook; the handbook expressly states that the city 'reserves the right to shut down any event that does not comply' with noise requests from event organizers, FMPD, or Code Enforcement. Outdoor restaurants and bars on First, Second, Hendry, and Bay Streets that operate after 11 p.m. typically rely on indoor amplified sound (with doors and windows controlled) or on special-event permits for outdoor stages. The Caloosa Sound Amphitheater and similar permitted venues operate under event-specific approvals that may extend beyond 11 p.m. when properly permitted.
