Practically, gas and battery leaf blowers may be used during normal daytime hours by homeowners and licensed landscapers; very early-morning (pre-dawn) or late-evening use can be cited as a nuisance under Sec. 54-196. There is no city-imposed registration of landscape contractors specifically for noise control, although contractors must hold a Florida Department of Business and Professional Regulation (DBPR) license and Lee County business tax receipt. Florida law does not currently preempt local leaf-blower regulation, but Fort Myers has not adopted a leaf-blower ordinance. HOAs and condominium associations within Fort Myers may impose stricter hours via their covenants.
