No county rule governs outdoor music. Allentown allows band concerts, block parties, carnivals and fairs outdoors only if sound stays within 10 dB(A) of the Table 1 limits, and limits any single location to ten such events per calendar year, unless a variance is granted.
Outdoor-event sound is regulated by municipal ordinance. Allentown provides that, unless a variance is obtained, band concerts, block parties, church carnivals, fairs or similar publicly or privately sponsored activities held outdoors shall not produce sound more than 10 dB(A) above the Table 1 land-use limits, and shall be limited to ten (10) occasions in a single location within a single calendar year. Separately, places of public entertainment may not exceed 90 dB(A) at a customer position without posting a hearing-impairment warning sign. Event organizers who need higher levels or more dates must apply to the Noise Control Hearing Board.
Violation ticket $100; summary conviction $100–$1,000 and/or up to 90 days imprisonment. Each day is a separate offense. A variance may impose conditions and time limits.
