Two Sec. 11-8 provisions cover outdoor music. Subsection (b)(9) declares it a violation to use any drum, bell, loudspeaker or other instrument to attract attention by creating noise for a performance, show, sale, display or advertisement. Subsection (b)(11) presumes a violation when mechanically amplified sound from a commercial establishment or private entertainment/recreation venue is heard 30 feet or more past the facility's property line between 11:00 p.m. and 7:00 a.m. Backyard events are also judged under the general standard weighing time, proximity and zoning. These rules apply in unincorporated Guilford County only.
Sheriff or designee may warn, then impose civil penalties of $200/$400/$500 for repeat offenses within a year; also a Class 3 misdemeanor and possible abatement action.
