Outdoor music and entertainment in unincorporated Monterey County is governed by Section 10.60.040 of the County Code. During the protected nighttime period, outdoor music that is loud and unreasonable, plainly audible at 50 feet (the standard added in 2019), or that exceeds the Table 1 exterior standards of 45 Leq dBA (hourly equivalent) and 65 dBA maximum measured at the property line, is prohibited. This means a permitted, properly zoned commercial venue can host an outdoor event that residential outdoor music could not. Large private events with outdoor music still require special-event permits coordinated through HCD, and the County's Civil Grand Jury report identifies unpermitted outdoor parties with amplified music as the dominant complaint source in North Monterey County.
Outdoor music violating Sec. 10.60.040, or held without required permits, can be cited by HCD code enforcement and the Sheriff as a misdemeanor, with fines up to $250 for a first offense and up to $1,000 for repeat offenses within 12 months, plus possible County Jail. The Sec. 10.60.040(C) exemption applies only where the event is on commercial or institutional premises and complies with applicable permits and zoning; otherwise the standard nighttime limits control.
