This means a permitted, properly zoned commercial venue can host an outdoor event that residential outdoor music could not. Large private events with outdoor music still require special-event permits coordinated through HCD, and the County's Civil Grand Jury report identifies unpermitted outdoor parties with amplified music as the dominant complaint source in North Monterey County.
Outdoor music violating Sec. 10.60.040, or held without required permits, can be cited by HCD code enforcement and the Sheriff as a misdemeanor, with fines up to $250 for a first offense and up to $1,000 for repeat offenses within 12 months, plus possible County Jail. The Sec. 10.60.040(C) exemption applies only where the event is on commercial or institutional premises and complies with applicable permits and zoning; otherwise the standard nighttime limits control.
