The amended section gives the DuPage County Sheriff's Department a citation option for "loud and raucous" amplified noise in unincorporated areas of the county.
The ordinance carves out exemptions for events on permits and for "sounds originating from the normal and intended use of the recreational facilities of schools, colleges and public parks between the hours of 9 AM and 11 PM." The ordinance directs that certified copies be sent to the DuPage County Sheriff, the DuPage County State's Attorney, and the Chief Judge of the 18th Judicial Circuit Court. Within incorporated municipalities (Naperville, Wheaton, Downers Grove, etc.) the city or village noise ordinance and local police, not the county, handle enforcement.
Violations are written as Sheriff's citations in unincorporated DuPage and prosecuted by the DuPage County State's Attorney in the 18th Judicial Circuit Court. Penalties follow the general penalty provisions of the DuPage County Code; the 2025 amendment was intended specifically to make residential amplified-noise complaints chargeable.
