Burlington County sets no grill ordinance. The NJ Uniform Fire Code governs where propane and charcoal grills may be used: they are barred from balconies, decks and porches of multifamily buildings and must stay clear of combustible construction. Detached one- and two-family homes are exempt.
Barbecue and propane-grill use follows the statewide NJ Uniform Fire Code (N.J.A.C. 5:70, adopting IFC Section 308), not any Burlington County rule. Charcoal burners, open-flame cooking devices and outdoor fireplaces may not be operated or stored on combustible balconies or decks or within 5 feet of combustible construction. Larger LP-gas grills, tanks over 2.5 pounds water capacity, must stay off combustible balconies and at least 10 feet from combustible construction. Both rules carve out an exception for detached one- and two-family dwellings, so a homeowner grilling in a backyard is fine, but apartment and condo residents generally cannot grill on their balcony. Each Burlington municipality's fire prevention bureau enforces these limits.
Enforced by the municipal fire official under the Uniform Fire Code; grilling in a prohibited location can bring fire-code penalties and removal orders.
