NYC Fire Code Section FC 307.5 (3 RCNY 307-01) makes it a violation to use charcoal or gas cooking devices on combustible balconies in any building with Group R-2 occupancy (3+ units), and within 10 feet of combustible construction. FDNY exemptions apply only where the building is fully sprinklered and the balcony is non-combustible. LPG container storage in any occupied building is limited to 1 lb water capacity under FC Section 6104; larger tanks may not be stored indoors. FDNY guidance allows backyard grills at one- and two-family homes with 10-foot clearance. Electric grills are exempt.
FDNY issues OATH summonses under FC 307.5 with civil penalties starting at $1,000 per violation and up to $10,000 for repeat violations. Building managers can be cited for tenant grills on common balconies. Violations may also trigger insurance non-renewal.
