Montgomery County has no separate barbecue ordinance; grilling is governed by the statewide Ohio Fire Code (OAC 1301:7-7-03). At single-family and two-family homes, you may grill freely on your own property using common sense. At apartments, condos, and other multifamily buildings, charcoal burners and open-flame cooking devices may not be operated on combustible balconies or within 10 feet of combustible construction. Exceptions apply where the building and its balconies are protected by an automatic sprinkler system, or where the fire code official approves. LP-gas cylinders for grills must be stored outdoors, not inside a home or attached garage, under the propane-storage rule.
Fire code officials and local departments can order removal of non-compliant grills, issue citations, and hold violators liable if a grill fire spreads. HOAs and landlords may impose their own bans.
