Montana adopted the International Fire Code, 2021 edition (ARM 23.12.601), which governs outdoor cooking near buildings. IFC 308.1.4 provides: 'Charcoal burners and other open-flame cooking devices shall not be operated on combustible balconies or within 10 feet (3048 mm) of combustible construction.' Exceptions include one- and two-family dwellings, buildings protected by an automatic sprinkler system, and small LP-gas devices whose container water capacity is 2.5 pounds or less. This means apartment and condo residents generally cannot grill with charcoal or full-size propane tanks on wood balconies. Single-family homeowners have more latitude but should keep grills clear of siding and eaves. Grilling in violation of the adopted fire code is a code violation; fire officials can order correction and issue citations, and violations during fire restrictions carry additional penalties.
